Morelli Law Firm filed suit yesterday on behalf of a passenger onboard Amtrak train No. 188 when it derailed last Tuesday on its route from Washington D.C. to New York.
The complaint, which you can read here , argues that as the train entered the Frankford Junction section of the track, a curve, the train accelerated from 70 miles per hour to approximately 106 miles per hour, instead of decelerating to the decreased speed limit of 50 miles per hour. As a result of this increase in speed, the train derailed less than a minute later.
The first car, in which Plaintiff was a passenger, was mangled and sustained the most damage of all the seven of the train’s cars. Due to Amtrak’s negligence and the resulting train wreck, Plaintiff sustained severe personal injuries including, but not limited to multiple fractures which required multiple surgeries, extensive medical treatment, and will require significant physical rehabilitation.
